1. General Provisions
These Terms of Service, hereinafter referred to as the “Terms”, define the rules for using the website available at https://www.flexfulfillment.eu, hereinafter referred to as the “Website”.

In these Terms, “FLEX.”, “FLEX. Fulfillment”, “we”, “us” or “our” refers to FLEX Logistik Deutschland GmbH.
These Terms apply only to the use of the Website. The actual provision of fulfillment, logistics, warehousing, shipping, returns, FBA prep or related operational services is governed by separate B2B commercial agreements, service confirmations, offers, order forms or contracts agreed individually with clients.
Information published on the Website is provided for general informational and business purposes only. It does not constitute a binding commercial offer unless this is expressly stated in a separate written offer or agreement.
2. Definitions
For the purposes of these Terms:
- User means any person, company or organization using the Website.
- Website means the website available at https://www.flexfulfillment.eu and its subpages.
- Electronic Services means services provided electronically through the Website, such as access to website content, contact forms, quote request forms, newsletter subscription forms or other online functions.
- Client means a business customer or prospective business customer interested in FLEX. fulfillment, logistics or related services.
- Content means all text, images, graphics, videos, logos, layouts, software, downloadable materials and other materials available on the Website.
3. Scope and Nature of the Website
The Website presents information about FLEX. Fulfillment, including fulfillment services, logistics services, warehousing, order fulfillment, FBA prep, returns handling, marketplace logistics, e-commerce logistics and related operational solutions.
The Website may provide the following free electronic functions:
- access to informational content about our services;
- contact forms and quote request forms;
- newsletter or marketing subscription forms, where available;
- access to resources, articles, guides, help content or forum-style content, where available;
- links to external tools, partner platforms or client systems, including myFLEX WMS, where applicable.
Using the Website does not create a logistics service agreement, warehousing agreement, transport agreement, fulfillment agreement or any other operational service agreement between the User and FLEX. Such agreements require separate commercial arrangements.
4. Technical Requirements
To use the Website properly, the User needs:
- a device with Internet access;
- an up-to-date web browser, such as Chrome, Safari, Firefox, Edge or another modern browser;
- cookies and JavaScript enabled for some Website functions;
- an active email address if the User wishes to use a contact form, quote request form or newsletter subscription.
We do not guarantee that the Website will function correctly on outdated browsers, unsupported devices or configurations that block essential website functionality.
5. User Obligations
The User agrees to use the Website in accordance with applicable law, good practice, these Terms and the intended purpose of the Website.
The User must not:
- submit unlawful, misleading, abusive, offensive, defamatory or infringing content;
- use the Website to send spam, unsolicited commercial messages or malicious content;
- attempt to gain unauthorized access to the Website, server, systems, forms, accounts or connected tools;
- interfere with the security, integrity or availability of the Website;

Submitting a form does not oblige FLEX. to accept the request, provide a quote, enter into a contract or provide services. We may respond, request additional information, decline the inquiry or redirect the User to another FLEX. entity, partner or website where appropriate.
Commercial information exchanged through the Website is preliminary unless confirmed in a separate written agreement or offer.
7. Newsletter and Marketing Communication
If newsletter or marketing subscription options are available, the User may subscribe voluntarily by providing the required information and, where required, giving consent.
The User may unsubscribe from marketing communications at any time using the unsubscribe link in the relevant email, where available, or by contacting us directly.
8. Intellectual Property
All Content available on the Website, including text, graphics, layouts, logos, images, videos, icons, designs, service descriptions and software elements, is protected by copyright, trademark and other intellectual property laws.
The Content belongs to FLEX., its affiliated entities, licensors, partners or other authorized rights holders.
The User may view the Website for personal or internal business purposes. The User may not copy, reproduce, modify, distribute, publish, sell, license, scrape, mirror or otherwise commercially exploit any part of the Website without prior written permission from FLEX., unless permitted by mandatory law.
The names “FLEX.”, “FLEX. Fulfillment”, FLEX. logos and related brand elements may not be used without prior written consent.
9. External Links and Third-Party Content
The Website may contain links to third-party websites, tools, platforms, articles, resources, partner pages or external services.
We are not responsible for the content, availability, accuracy, security, policies or practices of third-party websites or services. Accessing third-party websites is at the User’s own discretion and risk.
Where the Website includes embedded content from third-party websites, such content may behave as if the User visited the third-party website directly. Third parties may process data according to their own terms and privacy policies.
10. Availability of the Website

In particular, FLEX. is not liable for:

- loss of profit, revenue, data, business opportunities or goodwill;
- indirect, incidental, special or consequential damages;
- errors, omissions or outdated information on the Website;
- temporary unavailability, technical issues or interruptions;
- third-party websites, services, tools or embedded content linked from the Website.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law, including liability for intentional misconduct, gross negligence, injury to life, body or health, or other liability that cannot be excluded by law.
13. B2B Nature of FLEX. Services
FLEX. Fulfillment primarily provides services to business clients, online retailers, marketplace sellers, brands, importers and other commercial operators.
Unless expressly agreed otherwise, the logistics, fulfillment, warehousing, FBA prep, forwarding, returns and related operational services presented on the Website are intended for B2B clients and are subject to separate commercial terms.
Any service descriptions, performance claims, timelines, capacity references, warehouse location references, carrier references or process descriptions on the Website are indicative and may depend on operational availability, client requirements, product type, warehouse location, carrier conditions, marketplace rules and the final commercial agreement.
14. Complaints Concerning Website Functioning
Users may submit complaints concerning technical issues or the functioning of the Website by contacting us at [email protected].
A complaint should include:
- the User’s contact details;
- a description of the issue;
- the URL or part of the Website concerned;
- the date and time when the issue occurred, where possible;
- screenshots or other supporting information, where useful.
We will review Website-related complaints within a reasonable time and may contact the User for additional information if needed.

17. Consumer Dispute Resolution Notice
FLEX. Fulfillment primarily provides services in a B2B context.
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless participation is required by mandatory applicable law in a specific case.
The former European Online Dispute Resolution platform has been discontinued and is no longer available.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany, unless mandatory consumer protection laws provide otherwise.
For business Users, any disputes arising out of or in connection with these Terms, the Website or its use shall be submitted to the courts competent for the registered office of FLEX Logistik Deutschland GmbH, unless mandatory law provides otherwise.
For consumers, if any consumer law applies in a specific case, mandatory consumer protection rules and jurisdiction rules remain unaffected.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Website, services, technical tools, legal requirements or business operations.
